This breakup just got bitter.

Actress Sofia Vergara is busy promoting Hot Pursuit, her new comedy opposite Reese Witherspoon, in theaters Friday. But it’s Vergara’s drama with ex-fiancé Nick Loeb that is making the headlines.

According to Loeb, the former couple decided to freeze two female embryos while they were happily engaged. At 42-years-old, Vergara had plans to begin a family with Loeb after their wedding. Although the wedding was called off and Vergara is now engaged to Magic Mike hunk Joe Manganiello, Loeb still wants to bring the embryos to fruition, much to the dismay of Vergara.

Loeb filed a lawsuit against the Colombian-born actress and insists that he is happy to raise the embryos without the help of his former fiancé and use a surrogate instead.

It “makes no sense,” Vergara told Howard Stern this week on his Sirius XM radio show.

A child “needs a loving relationship of parents that get along, that don’t hate each other.” Vergara clarified, “I don’t hate him, but obviously he has a problem with me.”

The Modern Family star continued, “A kid needs parents. I wouldn’t imagine anyone saying that it’s sane to bring [into] the world kids that are already set up [with] everything wrong for them. It would be so selfish.”

Vergara has a lot of happy things to look forward to instead of worrying too much about the legal drama, she says.

In regards to her life with Manganiello, 38, and son Manolo from a previous relationship, “We’re having so much fun right now. We’re moving to our new house, he’s promoting Magic Mike, I’m doing this movie, we’re planning our wedding.”

Finally, Vergara says it's important to keep things in perspective. “So it’s like, we try not to think about this because we can’t do anything. It’s signed, it’s done, we have a contract and that’s it.”
